1. General Conditions

1.1 The words “website” or “Hub Lenses” shall mean www.hublenses.com and “webpage” shall mean this particular page on www.hublenses.com, “company” or “us” or “we” “our” shall mean www.hublenses.com and its owner Store Avenue LLC which operates from the UAE.

1.2 The abbreviation “UAE” shall mean the country of United Arab Emirates, the word “you” or “your” shall mean the user visiting, purchasing & or browsing www.hublenses.com

1.3 The words “your content” shall mean any audio, video text, images or other material you choose to display on this Website.

1.4 These Website Standard Terms and Conditions written on this webpage shall manage your use of this website. These Terms will be applied fully and affect your use of this Website. By using this Website, you agreed to accept all terms and conditions written in the “Terms & Conditions”.

1.5 You must not use this Website if you disagree with any of these Website Standard Terms and Conditions.

1.6 Minors or people below 18 years old are not allowed to use this Website.

1.7 Store Avenue LLC of which is Located & operating from the United Arab Emirates, and of which Hu Lenses / www.hublenses.com belongs to and operates under Store Avenue’s commercial license, takes no medical &/or professional responsibility on the health of your eyes or care of your contact lenses and by purchasing from www.hublenses.com you are confirming that you have consulted with your eye doctor and are fully aware of how to order appropriately(i.e. according to the guidance & professional assistance of your eye doctor), operate & care for the lenses you wish to purchase.

1.8 We reserve the right to deny service to any person at any time.

2. Intellectual Property Rights

2.1 Other than the content you own, under these Terms, Hub Lenses owns all the intellectual property rights and materials contained in this Website.

2.2 You are granted limited license only for purposes of viewing the material contained on this Website

3. Restrictions

3.1 You are specifically restricted from all of the following:

a) Publishing any www.hublenses.com material in any other media

b) Selling, sub-licensing and/or otherwise commercializing any Website material

c) Publicly performing and/or showing any Website material

d) Using this Website in any way that is or may be damaging to this Website, impacts user access to this website contrary to applicable laws and regulations, or in any way may cause harm to www.hublenses.com/ Store Avenue LLC or to any person or business entity involved.

e) Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website.

f) Using this Website to engage in any advertising or marketing.

3.2 Certain areas of this Website are restricted from being accessed by you and Hub Lenses may further restrict access by you to any areas of this Website, at any time, in absolute discretion.

3.3 Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.

4. Your content

4.1 By displaying your content, you grant Hub Lenses a non-exclusive, worldwide irrevocable, sub-licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

4.2 Your Content must be your own and must not be invading any third-party’s rights. Hub Lenses reserves the right to remove any of Your Content from this Website at any time without notice.

5. Disclaimer of warranty’s

5.1 a) Accuracy of billing and account information-We reserve the right to refuse any order you place with us.

b) We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

c) These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

d) In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

e) We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

f) You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

g) You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed. For more detail, please review our returns policy.

6. Return policy

6.1 for Hygene reasons given the nature of contact lenses, Hub lenses accept return of on opened packages unless in the rare exception of a manufacturing defect.

6.2 Hub Lenses provides easy returns on non-prescription/plano lenses should you wish to exchange your lenses or get a refund within 7 days of receiving your lenses. In this case, you will have to pay any tax, customs or handling charges involved.

6.3 Plano(without prescription) lenses can be returned within 7 days of receiving your lenses as long as they are in good condition and sealed in the original packaging. 

6.4 Unfortunately, prescription lenses may NOT be returned or cancelled once the lenses are produced as they are custom made to suit your requirements.

6.5 Cancellations

a) You will receive a notification if an order has been cancelled prior to shipping as you would qualify for a free refund (21 working days).

b) If already shipped, orders will be considered as returns if cancelled and the customer wll have to bear all related costs as mentioned in clause no. 6.2. Agai, prescription lenses cannot be cancelled once produced.

6.6 Manufacturing defects

a) In the case of manufacturing defects, please contact us within 7 days of receiving the product for a free like-for-like replacement.

b) Ensure to keep your receipt copy as you may be asked to provide the receipt for verification.

c) You may be required to provide an image of the damaged as long as well as a detailed description of the issue you are facing with the lens.

d) Once your case is assessed, you will receive an email from us confirming your free like-for-like replacement provided your case meets the criteria mentioned, "being a genuine manufacturing defect claim". You will receive the replacement lens within 10 business days after confirmation of the manufacturing defect.

7. Payments

7.1 We accept Visa and MasterCard payments through our trusted payment partners PayPal or Paytabs.

7.2 We feature a cash on delivery service for free within the UAE, and only at an additional USD 10 for GCC countries

7.3 We accept AED, USD, SAR, EUR, GBP, AUD, CAD, NZD, EGP or any other listed currency in the currency options.

7.4 UAE and GCC customers will be charged 5% V.A.T at checkout.

7.5 International customers will be charged taxes or customs fees according to the local customs authority in your country of residence. This amount will be collected by our trusted courier partner during delivery for shipments outside the UAE.

7.6 Our products prices, shipping agreements, discounts and general terms of service are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time.

7.7 We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the product or service.

8. Delivery

8.1 Before placing an order, you will need to create an account with us by signing up.

8.2 Please ensure to provide the correct information. You will be charged a fee(according to your country/state/city) for providing wrong delivery address information or for unsuccessful deliveries where you fail to answer your phone or call us/our courier partners back.

8.3 After you have placed your order, we will send you a confirmation directly to your registered email. Please ensure to provide an active email that you regularly use.

8.4 a) We have partnered with leading courier organizations including FedEx or Aramex provide you with premium delivery service.

b) You will receive a tracking/Air Way Bill no. once your order has been collected by our courier partners and subsequently, you will be contacted before your order is dispatched from the courier facility.

c) You are able to track your shipments on the designated courier’s website by clicking on the relevant courier’s icon found in Hub lenses footer below which leads you to our corresponding courier partner where you can enter the Air Way Bill #.

8.5 a) Order delivery time may vary upon your location, i.e UAE, GCC, all other international destinations and as well as the type of lenses ordered, i.e. Colour or Prescription contact lenses.

b) Colour lenses without power- U.A.E orders require 2-4 business days, GCC orders require 5-7 business days, and all other available international destinations require 8-10 business days.

c) Prescription lens orders- U.A.E orders require 3-5 business days, GCC orders require 7-10 business days, and all other available international destinations require 10-12 business days.

d)All estimations are subject to stock availability with us and our suppliers as well as for international order, your local customs procedures.

8.6 Shipping charges

a) Delivery is absolutely free for UAE customers.

b) GCC customers may avail of free international express shipping by spending USD 49 or more. Alternatively, there will be a fee of $9 for express shipping.

c) The majority of international countries we ship to may avail of free express international shipping with a minimum spend of USD 49 (please check the list of countries in the delivery information link found in the footer for more details). Alternatively, there will be a fee of USD 9-USD 18 for express shipping depending on the country.

d) Unsuccessful deliveries due to failure to answer calls from the designated courier or failure to be present at the stipulated time of delivery initially will result in an additional processing fee of USD 15. The order will be automatically cancelled if there are more than 2 unsuccessful attempts to delivery the contact lenses by our designated courier and the customer will have to bear all subsequent cost in addition to the initial processing fee of USD 15.

8.7 Taxes and customs charges.

a) Taxes and customs charges are NOT included in Hub Lenses displayed prices.

a) All UAE and GCC orders are subject to an additional charge of 5% VAT and which will be charged at checkout.

b) All other International orders are subject to taxes and customs charges according to the laws of the country you are located in. Any additional tax or customs charges apart from the prices displayed on Hub Lenses will be collected accordingly by our designated courier partner during delivery.

9. Limitation of liability

9.1 In no event shall Store Avenue LLC / Hub Lenses nor any of its directors and or employees shall be held liable for anything arising out of or in any way connected with your use of this website whether such liability is under contract.

9.2 Store Avenue LLC / Hub Lenses including its directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this website or the products purchased from the website.

9.3 Information Accuracy and Timeliness

a) We are not responsible if information made available on this site is not accurate, complete or current.

b) The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting your eye doctor.

c) Any reliance on the material on this site is at your own risk. Ensure to consult with your eye-care specialist before making a purchase.

d) This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only.

e) We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.

f) You agree that it is your responsibility to monitor changes to our site.

10. Indemnification

10.1 You hereby indemnify to the fullest extent Store Avenue LLC from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

10.2 Optional tools, we may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

10.3 You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement.

10.4 We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

10.5 Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

10.6 We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

11. Severability

11.1 If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

12. Variation of Terms

12.1 Store Avenue LLC / Hub Lenses are permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

13. Assignment

13.1 Store Avenue LLC / Hub Lenses are allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

14. Termination

14.1 The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

14.2 These Terms of Service are effective unless and until terminated by either you or us.

14.3 You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services, or when you cease using our site.

14.4 If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

15. Entire Agreement

15.1 These Terms constitute the entire agreement between Store Avenue LLC and you in relation to your use of www.hublenses.com , and supersede all prior agreements and understandings. 12. Governing Law & Jurisdiction

15.2 These Terms will be governed by and interpreted in accordance with the laws of the United Arab Emirates, and you submit to the non-exclusive jurisdiction of the state and federal courts located in the United Arab Emirates for resolution of any disputes.

15.3 Hub Lenses and Store Avenue LLC will not deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.

16. Changes To terms Of Service

16.1 You can review the most current version of the Terms of Service at any time at this page.

16.2 We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.

16.3 It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these terms of service constitutes acceptance of those changes.

17 Disclaimer

17.1 Hub Lenses does not take responsibility for the health of your eyes. Please consult with your eye doctor before making purchases on Hub Lenses. Any technical information regarding 9 contact lenses provided below is not to be used before consulting with your eye practitioner.

17.2 If your eyes are experiencing a hurting sensation, pain, discomfort, irritation, redness, itching, swelling, blurriness or loss of vision, please take off your contact lenses immediately and contact your eye doctor.

17.3 Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device & display of the colours accurately reflects the color of the products.

17.4 Your product may vary slightly from those images, all sizes, weights, capacities, dimensions and measurements indicated on our website are approximate only.

17.5 The product you receive when applied to your eyes may appear differently to the image shown on the website. You will need to take into consideration the natural color of your eyes before choosing to buy contact lenses from us.

17.6 We accept no responsibility or liability to you for your lack of suitability to wear contact lenses as detailed in the contact lens specification, for your overall suitability to wear contact lenses, or your use of any products ancillary to the wear and use of> t lenses by you.
